Ц.Нямдорж Тагнуулын байгууллагад “террор” хийж байна

ХЗДХ-ийн сайд Ц.Нямдорж Тагнуулын байгууллагад дахин “террор” хийж эхэллээ. Энэ удаад тэрээр эрх мэдлийн “халдлага” хийхээр шийджээ. Засгийн газар 2020 оны 3 дугаар сарын 22-нд ээлжит бусаар хуралдах үеэрээ УИХ-аар яаралтай горимоор хэлэлцүүлэхээр зэхэж буй Төрийн тусгай хамгаалалтын тухай хуульд нэмэлт өөрчлөлт оруулах тухай хуулийн төслийн талаар яамдаас санал авахаар болсон. Өөрөөр хэлбэл, УИХ-д өргөн барих эсэх нь цаг хугацааны асуудал болчихоод байна. Үндэсний аюулгүй байдалтай салшгүй холбоотой энэ асуудал дээр “дарь” нэмж Хилийн тагнуул, Цэргийн тагнуулын байгууллагууд ч Тагнуулын ерөнхий газрын харьяанаас “зугтах”-аар бэлтгэж эхэллээ. ХЗДХ-ийн сайд Ц.Нямдорж, Батлан хамгаалахын сайд Н.Энхболд нар ч энэхүү эрх мэдлийн “аян дайнд” нэгджээ. 


Төрийн тусгай хамгаалалтын тухай хуульд нэмэлт өөрчлөлт оруулах тухай хуулийн төслийн гол агуулга нь Төрийн тусгай хамгаалалтын газрыг Засгийн газрын тохируулагч агентлаг болгон тусад нь бие даалгах тухай юм. Тэгэхээр одоо Хилийн тагнуул, Цэргийн тагнуул ч бас тусдаа бие даасан, тохируулагч агентлагууд болох юм байх аа. Ингэж Тагнуулын ерөнхий газрын хүчин чадлыг тарамдуулах, сульдаах нь хэний хүсэл вэ? Яагаад энэ байгууллагыг хүчирхэгжих, нэгдмэл байх вий гэхээс айх болов? 


Яагаад ЗГХЭГ-аас Ажлын хэсэг байгуулж уг хуулийн төслийн хэрэгцээ, шаардлагын талаар судалсан тайлан хийлгэсэн юм бол? Хэрвээ Үндэсний аюулгүй байдал талдаа буюу улс орны эдийн засаг талдаа гойд ноцтой шаардлага байгаагүй юм бол дэлхийн хэмжээний цар тахалтай тэмцэж, “өндөржүүлсэн бэлэн байдал” зарласан цаг мөчтэй зэрэгцүүлэн Засгийн газрын хуралдаанаар ийм санал авах тухай яаравчлах ямар шаардлага байв? 



Үүнээс зөвхөн улс төрийн хийдлийг, олон нийтийн бужигнааныг ашиглаж шахалт дарамтын аргаар хуулийн төсөл батлуулж санасандаа хүрэх нь гэсэн хардлага төрж байна. Үүнийг тус салбарынхан хүсээд байна уу гэвэл тийм биш. Харин ч Тагнуулын ерөнхий газрын Ахмадын холбоо ГҮТББ, Монголын тагнуулын байгууллагын хурандаа нарын холбоо ГҮТББ, чөлөөнд гарсан генералууд нэгдэж уг хуулийн төслийг эсэргүүцсэн өргөдлүүдээ зохих байгууллагуудад илгээсээр байна. Сүүлийн хэдхэн хоногт ТТХГ-ын анхны даргаар ажиллаж байсан хурандаа Д. Бадарч, ТЕГ-ын дэд дарга, ТТХГ-ын дарга асан, хошууч генерал Д.Чимэд-Юндэн, ТЕГ-ын дарга асан, бригадын генерал Н.Ганболд нарын байр суурийг сонирхлоо. “Хэрхэвч болохгүй шийдвэр гаргах гэж буй”-г батлан хэлж буй тэдний дэргэд Ц.Нямдорж бол улстөрч билээ. 


Харин түүний улайраад байгаа, Тагнуулын байгууллагын хүчгүйдүүлэх зорилго бүхий, хуулийн аргаар хийх гэж буй“халдлага” нь улс төр хийж даанч болохгүй сэдэв! Төрийн тусгай хамгаалалтын газрын өнөөдрийн эрх мэдэл, эзэмшил сэлт огт багадаагүй. 


Хардах шалтгаан цөөнгүй байна. Хамгийн гол нь УИХ-ын сонгуулийн өмнөхөн яагаад энэ асуудлыг яаран шийдэх болов? Дотоодын цэргийг бужигнуулсан шиг Тагнуулын ерөнхий газрыг бужигнуулж түүний харьяа дахь Төрийн тусгай хамгаалалтын газар, Хилийн тагнуулын газар, Цэргийн тагнууулын газрыг салгаад тэр газар тус бүр нь галт зэвсэг, сум хилээр оруулж ирэх гүйцэтгэх ажиллагааны эрх өгөөд байх ямар шаардлага гарав. Цэргийн нэгдсэн холбооны тэргүүн У.Хүрэлсүх, түүний зөвлөх Л.Алтангэрэл нарын “ивээлээр” хариуцлага хүлээдэггүйТТХГ-ын дарга, хурандаа П.Батаагийн адал балмад түүх, үйлдсэн хэргүүд ноцтой. Сонгуулийн үеэр үймээн самуун гарвал энэ олон зэвсгийн эрх мэдэлтнүүдийнхээ хэнийг хардах вэ, бүгдээрээ хариуцлага хүлээх үү? Тиймээс энэ бол зөвхөн даргын ширээ биш галт зэвсэгтэн, цэргийн өндөр цолтой эрх мэдэл юм!!! Ийм эрх мэдлийг будаа шиг цацаж тарааж болохгүй!


Төрийн тусгай хамгаалалтын тухай хуулийн дагуу 1995 оны 7 дугаар сард Засгийн газрын 127 дугаар тогтоолоор Төрийн тусгай хамгаалалтын газар байгуулагдаж, хамгаалалт, үйлчилгээний хэлтэс, харуулын алба, Төрийн ордны хамгаалалтын алба, тусгай үйлчилгээний авто гарааш гэсэн бүтэцтэй харьцангуй биеэ даасан, төсвийн хувьд Сангийн яамтай шууд харьцах, боловсон хүчнээ өөрөө томилох, чөлөөлөх эрхтэйгээр зохион байгуулагджээ. Үүн дээр нэмж одоо оруулах өөрчлөлтөөр Гүйцэтгэх ажлын үед хийх зэвсгийн үзлэг, галт зэвсэг, сум, техник хэрэгсэл хилээр оруулж ирэхэд зөвшөөрөл өгөх, импортоор худалдан авахад НӨАТ-аас чөлөөлөгдөхийн тулд Гүйцэтгэх ажиллагааны тухай хуульд заасан ТЕГ, ЦЕГ, АТГ, ШШГЕГ-тай барьцаж эрх мэдэл эдлэх гээд байгаа нь “Төрийн тусгай хамгаалалтын газар Гүйцэтгэх ажиллагаа явуулдаг байх ёстой” гэсэн агуулгаа илтэд тодорхойлж байна.


2017 оны 10 дугаар сарын 26. ХЗДХ-ийн сайд Ц.Нямдорж “Би Тагнуулын ерөнхий газрын даргыг солино” гэж мэдэгдсэн. Тэр өдөр Ц.Нямдорж сайд “Жилийн өмнөөс Тагнуулын дарга намайг тагнаж байсан. Манай улсын үндэсний аюулгүй байдлыг хангах үүрэгтэй гадаад тагнуулын байгууллага улстөрчдийг тагнадаг, хууль хяналтын байгууллагыг хянадаг. Томилгоогоор дамжуулж, өөрсдийн хүнээ цагдаад шургуулж, цагдааг удирдах ажил хийж байгаа. Би үүнийг нь цэвэрлэнэ. Би ер нь цагдаагийн байгууллага дотор өөрийн мэддэг хүрээнд цэвэрлэгээ хийнэ. Цагдаагийн даргыг цагийн дотор солино” гэхчлэн тэсрэлттэй мэдэгдэл хийсэн. Мэдэгдсэн бүхнээ хэрэгжүүлсэн. Өөрөөр хэлбэл, энэ бол “Хятадын тагнуул”, “Английн тагнуул” хоёрын “аальгүйтэл” биш байлаа. Маш ноцтой, том зорилготой “террор” байсан юм. Харин Мөн Ц.Нямдорж, Ж.Батзандан нарын амласан “Хоёр долоо хоногийн дотор С.Зориг агсныг хөнөөсөн хэргийн захиалагчийг олж зарлана” гэсэн нь л биелээгүй байна. Ерөөсөө тэр эрүүдэн шүүсэн бичлэгийг хийсэн өндөр түвшний камер нь ч олдох эсэх нь тодорхойгүй, ёстой л “энтертайнмент” гэгч биш байгаасай гэсэн хүлээлт үлдээгээд байгаа юм.


Цэргийн тагнуул гэдэг байгууллагын дурсамжийг “Казино” Д.Энхбаатарын түүхээс харж болно. “Казино” Д.Энхбаатар 1996-2000 онд УИХ-ын Тусгай хяналтын дэд хороонд Ц.Нямдоржтой хамт ажиллаж байв. Тэр үед Цэргийн тагнуулын газарт ахмад цолд хүртлээ алба хашиж, мэргэжлийн цэргийн тагнуулч Цэргийн тагнуулаар ажиллаж байсан Д.Энхбаатар, Цэргийн прокурорт олон жил болсон Ц.Нямдорж нар тагнуулын байгууллагыг “сүүдрийн” хэлбэрээр ажиллуулах шахаж байсан гэдэг. Хожим нь “Казиногийн” хэргээр хоригдоод гарсан Д.Энхбаатар ЗХЖШ-ын Хяналт шалгалт, Үнэлгээний газрын дарга, улмаар ЗХЖШ-ын Цэргийн тагнуулын газрын дарга болтлоо дэвшээд зогсохгүй 2012 оны 3 дугаар сард Ерөнхийлөгч Элбэгдоржийн зарлигаар бригадын генерал цолоор шагнагдсан байдаг. Ийнхүү өндөрт мандаж явсан тугийг газарт буулгаж ирсэн хуулийг Б.Хурц гардан хийсэн гэдэг. Тэрээр УИХ-аас 2015 онд Тагнуулын байгууллагын тухай хуульд нэмэлт өөрчлөлт оруулах саналаа лоббидуулсаар Тагнуулын байгууллага нь цэрэг-стратегийн болон хилийн тагнуулын үйл ажиллагаа явуулахаар болж, Тагнуулын Ерөнхий Газрын харьяанд Хилийн болон Цэргийн тагнуулын газрыг шилжүүлэн, Тагнуулын Ерөнхий Газрын дарга нь Цэргийн тагнуулын газрын даргыг Зэвсэгт хүчний Жанжин штабын даргатай зөвшилцөн томилох, Хилийн тагнуулын газрын даргыг хил хамгаалах байгууллагын даргатай зөвшилцөн томилох бүрэн эрхийг хэрэгжүүлэхээр болсон. 


Ингэснээр хилийн тагнуул, цэргийн тагнуулын байгууллага хэрхэн замбараагаа алдаад, тус байгууллагын удирдлагууд нь рецедивүүд”-тэй халаас нэгтэй болсон тохиолдол хүртэл гарчихаад байсныгцэгцэлснийг салбарынхан нь хэлээд өгнө. Наад зах нь Д.Энхбаатарыг ажлаа өгөх үед түүний орлогч, хурандаа М.Ганбат зэвсэгт хүчний шүхрийн ангид шаардлагатай хэрэгсэл нийлүүлэхдээ хөрөнгө мөгө завшсан байж болзошгүй асуудраар АТГ-т шалгуулж, үүндээ даргыгаа холбоотой гэх мэдүүлэг өгсөн гэх мэдээлэл хэвлэлүүдэд гарч байсан. 


ЗХЖШ-ын харьяанд байсан Цэргийн тагнуулын газар, ХХЕГ-ын Хилийн тагнуулын газрыг татан буулгаж, Тагнуулын ерөнхий газарт нэгтгэх асуудлыг 2015 оны 7 дугаар сарын 7-нд УИХ хаалттай хуралдаж шийдэж байсан. Тагнуулын байгууллагын тухай хуульд нэмэлт өөрчлөлт оруулах тухай хуулийн төсөл байсан шиг санаж байна. 


Энэ удаад ч Төрийн тусгай хамгаалалтын газрын тухай хуульд нэмэлт өөрчлөлт оруулах тухай хуулиар биш бол Тагнуулыг байгууллагын тухай хуульд нэмэлтөөрчлөлт оруулах тухай хуулийг УИХ-д яаралтай горимоор өргөн бариад, хаалттай горимоор хэлэлцээд баталчих нь цаг хугацааны асууудал болоод байна. Хэрэв Үндэсний аюулгүй байдал талаасаа хууль эрх зүйн ийм алдаатай алхам хийвээс сонгууль дөхсөн төдийгүй нийтээрээ хуралдахыг хүртэл хориод байгаа өндөржүүлэн бэлэн байдал зарлахаас ч “цээрлэж” буй энэ цаг үед мөддөө засаж залруулах боломжгүй том алдаа гарч болзошгүй.


Хэрэв тийм алдаанд хүрэх аваас Тагнуулын байгууллагын хүчийг сульдаах, галт зэвсэгтэй эрх мэдэлд тэмүүлсэн хэсэг бүлэг хүний эрх ашигт л нийцэх бөгөөд улс төрийн сонгуулийн өмнө зайлшгүй болгоомжлох гашуун сургамжтай энэ цаг үед иргэдийн амгалан тайван байдал алдагдах, Үндэсний аюулгүй байдалд заналхийлсэн үйлдэл гарлаа гэхэд түүний эзнийг олж тогтооход тун хэцүү нөхцөл байдлыг өнөөгийн УИХ баталж өгөөд явж мэдэхээр байгаа тул сануулж сэрэмжлүүлэх шаардлагатай болж байна. Төвлөрсөн эрх мэдэл, нэгдмэл бодлогыг сааруулах нь төсвийн байгууллага шинээр байгуулаад хэдэн төгрөг зарцуулах бол гэдгээс тэс өөрөөр, Үндэсний, Үндэстний аюулгүй байдалтай холбоотой асуудал гэдэг талаас нь анхаарч, хууль санаачлагчдыг, сурцтай “опперац”-ийнхныг биш мэргэжилтнүүдээ сонсож, иргэдээ бодож шийдвэр гаргах учиртайг зориуд анхааруулж байна!
